Are pooling and service agreements all public thereby filed with the SEC?  If not is there anyway to identify in the documents I have whether the document representing securities on my loans are private?

 

Most of the Private Placement Trust has NO Prospectus Filings. Explained below. Bloomberg LLD can verify that the loan is in the {Private Placement Trust. (See Bloomberg Audit Screenshot below). Not all PSA’a  are available to the public, pursuant to the 424B5 rule, only the ones that are listed with the SEC and even then you must check and see if the trust was downgraded by Moodys and Fitch or another financial platform because if they were downgraded then the SEC would pull it public filings.

* This is a private placement as defined in Rule 144a of the Securities Act of 1933. As such, a prospectus and other investor information are not publicly disclosed. This type of report may otherwise include extracts of the prospectus supplement (Form 424B5) indicating the securitization transaction parties; assignment and delivery of the mortgage loans; and extracts of the Pooling and Servicing Agreement, notably the conveyance of the loan verbiage generally placed into “Section 2.01” of such agreements. This private placement is an indication that the note has been sold and securitized to third parties similar to publicly reporting mortgage trusts.

Does the audit include the names of Trustees in the transfers process? And most importantly is the original Trustee. Which in my case I know and is the primary defendant.

 

Answer: 

The Trustee will always be named especially when the property goes on Foreclosure. On Lis Pendens the name of the Trustee will show up on the documents because the Trustee is the one that holds all the loan for the benefit of the Certificateholders. You will always see it on the Assignment.

 

Question about service for Fannie Mae and MERS

Just wanted to let you know the ADDRESS for FANNIE MAE service is not taking on the System as a Valid Address. [Was informed that only Attorneys can serve via email at: serviceofprocess_request@fanniemae.com].

ALSO – MERS SERVICE ADDRESS on the Document for SameDayService for Mers is coming up INVALID when it is inputted in MAPQUEST, I think they have a Headquarters in Washington DC

Answer:

Service of Process can be tricky, especially with these alleged Trusts.  I know of no rule, law or statute that only attorneys can serve at the email address for Fannie Mae.  That may be a Fannie Mae rule.

As for MERS, if MERS is licensed to do business in the state where the lawsuit is filed, they should have a Registered Agent in that state.  An individual or a process server can easily look up MERS on the state Sec. of State website and find out who the Registered Agent is and the Registered Agent’s address where they can accept service of process.
